LexiCAD Terms of Service

Effective date: October 11, 2026

These terms are the agreement between you and LEXICAD TECHNOLOGIES INC., an Ontario corporation (“we”, “us”, “our”), for your use of the LexiCAD website and service (“LexiCAD”).

Summary

This summary is here to help you, but it is not the agreement. The agreement is contained in the sections below.

  • LexiCAD is an AI design tool. Designs are generated by AI. No person reviews them before you receive them and nothing is physically tested. Check any design yourself before you rely on it (section 5).
  • Your designs are yours. We place no limits of our own on making, using or selling what you design, and we do not publish your designs. We do not promise that a design is free of other people’s rights (section 6).
  • You are responsible for what you make. You are the maker of anything produced from a design. If you sell, give away or share something you made, you take on full liability for it. If a claim about it is made against us, you defend us and repay our losses and legal costs (sections 5 and 12).
  • Credits are prepaid, and credits you buy do not expire with time. Credits are used as the AI agent works, including work you stop or are not happy with. Work lost because our servers failed is not charged. Unused credits are lost if you delete your account. Purchases are final and are not refunded, except where the law requires a refund (section 8).
  • We give no warranties, and we are not liable for loss or injury caused by a design or by anything made from it, to the fullest extent the law allows. If the law makes us liable anyway, our liability is capped at CAD $100 or less (sections 10 and 11).
  • Training. Unless you turn it off in Settings or during sign-up, de-identified versions of your chat interactions and designs may be used to train AI models, by us and by organizations we provide or sell them to. Turning it off is free and you lose no features. Deleting a design does not remove a copy already taken for training (section 7).
  • Changes. We email you at least 30 days before a material change to these terms (section 15).
  • Ontario law applies and disputes are heard in Ontario. Claims are brought individually, not as a class, where the law allows (section 16).

1. About these terms

1.1 Accepting. You accept these terms when you tick the box at sign-up. If you use LexiCAD without an account, for example by opening a shared design or downloading its files, you accept these terms by doing that; sections 1, 4, 5, 6.2, 6.6, 10 to 12 and 14 to 18 then apply to you, and a design you download counts as one of your designs for sections 5 and 12. If you do not agree to these terms, do not use LexiCAD.

1.2 Privacy. Our Privacy Policy explains how we handle personal information. You agree to it at sign-up as well.

1.3 Organizations. If you use LexiCAD for a company or other organization, you confirm that you have authority to accept these terms for it, and “you” includes that organization.

2. Your account

2.1 Age. You must be at least 13 to create an account. By creating one you confirm that you are an adult where you live (18 or 19 in Canada, 18 in most other places), or that your parent or guardian has read these terms and accepted them. A parent or guardian who lets a child use LexiCAD accepts these terms as a party to them and is responsible for the child’s use, including for what the child makes (sections 5 and 12). Credits may be bought only by an adult. Whoever pays for credits on an account accepts these terms and is responsible for that account’s use. If we learn that an account belongs to a child under 13, we delete the account.

2.2 One person, one account. An account is for one person. Do not share it or hand it to someone else. Creating multiple accounts to obtain multiple free trials is against our terms of service.

2.3 Your email address. You must give a real email address that you control and keep it current. It identifies your account and is how we reach you. We send notices under these terms to that address, and a notice sent there counts as given to you. You agree that emails and other electronic records, and your tick to accept, have the same effect as a signed paper document.

2.4 Security. You are responsible for what happens under your account. Keep your password and your email account secure, and tell us promptly at support@lexicad.com if you think someone else has used your account.

2.5 Emails. Emails needed to run your account, which the Privacy Policy lists, cannot be switched off. Notification emails about your designs are sent only if you turn them on. Marketing email is sent only if you opt in, and you can unsubscribe at any time.

3. The service

3.1 What LexiCAD is. You describe an object and an AI system produces a 3D model of it, which you can view, adjust, regenerate and download. LexiCAD can also produce other file types including but not limited to images and videos. Descriptions can include other files like images or 3D models. LexiCAD is an AI system. Its messages, images and design files are generated by AI and can be wrong.

3.2 It changes. We may add, change or remove features, the AI models offered, limits and file formats. We do this to improve the service, to respond to changes in the technology and in what our providers offer, for security, and to comply with the law.

3.3 Availability. We work to keep LexiCAD running, but we do not promise that it will be available at any particular time or without interruption. Work you start normally continues in the cloud if you close the page.

3.4 Limits. LexiCAD has limits on, for example, file sizes, storage, the number of designs in progress, and how long a single job may run. We may refuse an upload or a request that exceeds them.

3.5 Stored files. Your design and its history are kept while the design exists. Some generated files are cleared after a period of inactivity, as described on our pricing page and in the Privacy Policy, and can usually be generated again. Generating them again uses credits like any other work. In rare cases an older version of a design may no longer regenerate, or may regenerate differently. Uploads on an inactive design are reduced to a small allowance, and an unsent draft is discarded after 7 days; these cannot be generated again.

3.6 Help. Asking how LexiCAD works is free. Start by asking the in-app design agent or help agent. The support address is support@lexicad.com. We do not promise a response time for support questions; the Privacy Policy gives the time limits for requests about your personal information.

3.7 What the AI cannot do. The AI, including the help assistant, cannot change these terms and cannot make a promise or an exception for us. If the AI says something about refunds, credits, prices, your account or your legal rights that differs from these terms, these terms apply. Only an email from support@lexicad.com can agree to an exception.

4. What you may not do

4.1 Things you must not ask LexiCAD to design. Do not use LexiCAD to design:

  • a firearm, or a frame, receiver, suppressor, conversion part or other firearm part;
  • an object whose clear purpose is to harm people; or
  • anything requested in order to harm someone.

LexiCAD is built to refuse requests like these, and may refuse others. If such a request is not refused, making it is still a breach of this section. The AI providers we use may also refuse a request on their own safety grounds.

4.2 Conduct. You must not:

  • use LexiCAD in a way that breaks the law, including export-control and sanctions laws (section 17.6);
  • upload, create or share anything that infringes someone else’s intellectual property or other rights, or that you do not have the right to use;
  • upload sensitive personal information about other people;
  • try to bypass or disable LexiCAD’s safety rules, limits or access controls, or try to get the AI to ignore its rules;
  • reverse engineer LexiCAD, or try to extract or reproduce its software, models, methods or other internal workings, except where the law gives you a right to do so that cannot be removed;
  • use LexiCAD to build or train a competing design service, or resell access to LexiCAD (this does not limit what you may do with an object you make);
  • use bots, scrapers or other automated means to access LexiCAD; or
  • interfere with LexiCAD or overload it.

4.3 What we may do. We may refuse a request, remove a shared link, and suspend an account that breaks this section (see section 13.4 for more details). We may also block or delete a design, and stop its files being downloaded, where it breaks section 4.1 or 17.6, where a court or authority requires it, or where we find that a complaint under section 9.5 is valid. If we learn of something that suggests a serious crime threatening someone’s life or safety, we may report it to the authorities.

5. AI-generated designs and your responsibility

5.1 Designs are generated by AI and are not verified. Every design, model, drawing, render, animation, measurement and statement LexiCAD produces is generated by an AI system from your description and input files. No person reviews it before you receive it. Nothing is physically tested. No licensed engineer or other qualified professional has checked, approved or certified it.

5.2 What that means. Please be aware that:

  • a design may contain errors, may not do what you asked, and may be unsuitable or unsafe for what you intend;
  • LexiCAD is a design tool. It is not an engineering service, and nothing it produces is engineering or other professional advice;
  • LexiCAD cannot measure or test your material, your printer, cutter or other machine, your machine settings, the exact fabrication conditions, or the conditions and loads it will meet. It works only from what you tell it, cannot check what you tell it, and can get a design wrong even when you have said exactly what the object must do.

5.3 You verify before you rely. Before you make or use anything from a design, you are responsible for checking it, including its dimensions, strength, fit, material and safety, and for meeting any law, code, standard or certification that applies. Take particular care with anything that carries weight, holds or protects a person, is used by or near children, or could injure someone or damage property if it failed. Do not rely on such a part unless it has been properly verified, by a suitably qualified person where the risk calls for one.

5.4 Cautions. LexiCAD may show a short caution note beside a design. It is a reminder of this section, not a safety assessment. A design with no caution is no safer than a design with one. Where the caution note and this section differ, this section applies.

5.5 You are the maker. You give the instructions, you decide whether to accept a design, and you decide whether and how to make it, use it, sell it or give it away. You are treated as the designer and the maker of anything produced from a design. Anything you make, sell or give away is your product and your responsibility, not ours.

5.6 If you sell or give away an object made from a design, or share its files, you take on full liability for it towards the person who receives it and anyone else it affects. You pass it on as your own product. You must not describe it as made, tested, approved or guaranteed by us. Any claim about it is to be made against you, not against us or our people, and if one is made against us, section 12 applies.

5.7 Do not rely on the AI’s word. LexiCAD and its AI may say things about a design, including about its safety, strength, fit, dimensions, printability, cost or legality. The AI can say things confidently and be wrong. Treat what it says as unverified, and do not rely on it without checking as section 5.3 describes. You make and use anything from a design at your own risk.

5.8 This section describes what LexiCAD is and what you agree to by using it.

6. Your content and your designs

In these terms, your content means what you type, dictate, draw and upload. Your designs means the models, files, images and other output LexiCAD produces for you.

6.1 You own your designs. You may reproduce, make, use and sell them. To the extent we hold any rights in them, we assign those rights to you. We do not claim ownership of your designs. We do not show them to other users or to the public, and there is no gallery or marketplace. The uses we make of them are the ones in sections 4.3, 6.4 and 7, and disclosure where the law requires it.

6.2 What we do not promise. AI-generated material may not be protected by copyright or other rights. We do not promise that a design is protected, that it is unique, or that it does not resemble or infringe someone else’s work.

6.3 Your content. You keep any rights you have in your content. You confirm that you have the right to use it with LexiCAD.

6.4 Permission to run the service. You give us permission to store, copy, process, adapt and display your content and your designs as needed to provide LexiCAD to you, to keep it secure, to give you support, to review a report or a suspected breach of these terms, and to deal with a payment dispute or a legal claim. That includes sending them to partner companies, and showing a design to anyone who has a link you created. Section 7 sets out the further permissions you give.

6.5 Feedback. If you send us suggestions or feedback, we may use them freely without payment or obligation to you.

6.6 Our property. LexiCAD itself, including its software, models, methods, design, name and logo, belongs to us or our partners. These terms give you the right to use the service and nothing more.

7. Training and other uses of your content and designs

7.1 Training. Unless you turn training off in Settings or during sign-up, your content and your designs may be used to train AI models. That means the content itself, not just statistics about it. It may be used by us and by other organizations we provide or sell it to. Before anything is used for training or provided to anyone for that purpose, it is de-identified: we remove names, company names, contact details and other details that directly identify a person. Details like writing style are not removed, so there is no guarantee the data is not re-identifiable.

7.2 Your permission. For designs created while training is on, you give us a non-exclusive, worldwide, royalty-free permission to copy, adapt and use your content and those designs to develop, train and test AI models, and to provide or sell them to other organizations for the same purpose. This permission continues after you delete the design or your account, because a copy already taken may remain (section 7.4).

7.3 Your choice. Turning training off is free, can be done at any time and loses no features. The choice in force when a design is created is recorded on that design and stays with it, so changing the setting affects only designs you create afterwards, in either direction. The Privacy Policy says how to ask about a design you already created. A change to these terms will not extend training to a design that already exists.

7.4 Deletion and training. If training was on when you created a design, deleting that design does not guarantee that a copy already taken for training is removed.

7.5 Understanding our users. We may copy and analyse your content and designs to understand who uses LexiCAD and what they make, including for product and marketing studies, and to find where the AI performed poorly. This can include human review. You give us permission for this.

7.6 When a person may read your design. One of our staff may read a design and its conversation to provide support, to review a report or a suspected breach of these terms, to deal with a payment dispute or a legal claim, and to analyse performance of the AI on designs (section 7.5). This applies whether training is on or off.

7.7 The Privacy Policy says more about these uses.

8. Credits and payment

8.1 Credits. LexiCAD is paid for with credits. Purchased credits are ones you buy. Free credits are ones we give you without charge. A credit is a unit for measuring use. Credits have no cash value, cannot be exchanged for money, and cannot be transferred to another person or account.

8.2 How credits are used. Credits are used as work is done: for the AI’s work on your design, including when it asks you questions; for dictation you send; and for the computing time used to build and regenerate files. Asking how LexiCAD works is free; help requests (in both the main design chat and on the help page) do not count towards metered usage. The work is measured as it happens, so the amount a design will use is not known in advance and there is no quote before it is built. You can set a limit on what the AI’s work on a design may spend; that limit does not cover regenerating files. A render or animation that you start yourself is different: its exact credit cost is shown before you start (this does not apply to free credits or a free trial).

8.3 What is and is not charged. If our servers fail and work in progress is lost, the lost work is not charged. Otherwise credits are used for the work done, whether or not it produces what you wanted. That includes a run you stop, a run that ends at a limit you set or when your balance runs out, a request that is refused, a turn the AI could not complete, a run that produces no files, and a result you are not satisfied with.

8.4 Purchased credits do not expire with time. They end only in these cases: you delete your account (section 13.2); we delete or close it (sections 2.1 and 13.5); the credits bought with a payment that is disputed and returned to you (section 8.10); or LexiCAD closes (section 8.5). Credits cannot be used while an account is suspended (section 13.4). We may also correct a balance that is wrong because of an error.

8.5 If LexiCAD closes. If we decide to close LexiCAD, we will give at least six months’ notice by email and on the website, and your credits remain usable for that period. Credits left at the end of it are not refunded, except where the law requires.

8.6 Free credits. Free credits, such as beta credits, may carry an expiry date and are used before purchased credits.

8.7 Prices. We may change the price of credits for future purchases. We may also change how many credits a piece of work uses, for example when what our AI and cloud providers charge us changes. A change of that kind never removes credits or reduces the number you hold, but the same credits may then buy less work.

8.8 All purchases are final. Payments are not refundable and credits cannot be returned for money, except where the law requires a refund. Unused credits are lost when you delete your account. If there is a problem with a charge, email support@lexicad.com.

8.9 Payment. Payments are processed by Stripe. Prices are shown before you pay, in the currency named. Any tax that applies is shown before you pay. We email an invoice for each purchase. If you are charged twice or charged the wrong amount, tell us and we will correct it. We are not responsible for fees or delays caused by your bank or card issuer.

8.10 Payment disputes. If there is a problem with a charge, email support@lexicad.com first. If a payment to us is disputed or reversed through your bank or card issuer:

  • while the dispute is open, we stop any work in progress, suspend the account and hold its credit balance;
  • if the dispute is resolved in our favour, the balance is restored;
  • if the payment is returned to you, the credits bought with it are removed. If some of them have already been used, the same number is removed from the rest of your balance, because that work was not paid for;
  • in both cases the account can then be used again with the credits it holds, but it can no longer make purchases.

Throughout, you can still view your designs and download the files you could download before (except a design blocked under section 4.3). This section does not limit any right the law gives you to dispute a charge.

8.11 Free trial. A new account may be offered a free trial. The trial has limits on how much it can be used, and files from it can only be downloaded once you have bought credits. One trial is available per person, and deleting the trial design does not give you another. We may pause, limit or withdraw free trials.

9. Sharing designs

9.1 Sharing by link. You can share a design by a link. A person with the link cannot change your design. They can view it without an account, and unless you turn downloads off, they can download its files and make the object. Shared designs are not listed or searchable on LexiCAD, and we ask search engines and AI crawlers not to index them.

9.2 What a shared page shows. The page shows the design and its name, which is created from your prompts and which you can change. You choose whether your conversation is shown. If you share the conversation, it is visible to anyone with the link, including everything you typed, the files you attached (and their names) and your answers to the AI’s questions. Check what you are sharing before you share it.

9.3 Stopping. You can stop sharing at any time. It can take a short time for a link to stop working. We can remove the link from LexiCAD; we cannot remove copies or preview images that other websites already hold.

9.4 Your responsibility. You are responsible for what you share and for who you send a link to.

9.5 Reporting a shared design. If you believe a shared design is unlawful or infringes your rights, email support@lexicad.com. We accept reports in English. Include:

  • the link;
  • what the problem is and why;
  • your name and contact details;
  • a statement that the information is accurate and given in good faith; and
  • for a copyright complaint: the work you say is copied, a statement that you are the rights owner or authorized to act for them, and your name as a signature.

A person reviews each report and we reply to tell you what we decided. We do not routinely monitor shared designs.

9.6 What we may do. We may remove a shared link or block the design (section 4.3), and may suspend the accounts of people who repeatedly infringe others’ rights. The account holder can write to support@lexicad.com to ask why and to contest it.

10. No warranties

10.1 LexiCAD and everything it produces are provided “as is” and “as available”. To the fullest extent the law allows, we give no warranties, conditions or guarantees of any kind, whether express, implied or statutory, other than those the law does not allow us to exclude. This includes any implied warranty or condition of merchantability, fitness for a particular purpose, quality, accuracy, title and non-infringement. In plain words: we do not promise that LexiCAD or a design will be good enough for what you want to do with it.

10.2 In particular, we do not warrant that a design will be accurate, safe, strong, manufacturable or suitable for any purpose; that it will be free of errors; that it will not infringe anyone’s rights; or that LexiCAD will be uninterrupted, secure or error-free.

11. Limit of liability

In sections 11 and 12, our people means the directors, officers, shareholders, employees, contractors, agents and affiliates of LEXICAD TECHNOLOGIES INC., and anyone who takes over its business, and our service providers means the companies that help us provide LexiCAD, including those listed in our Privacy Policy.

11.1 What we are not liable for. Subject to section 11.3, and to the fullest extent the law allows, we, our people and our service providers are not liable to you for any loss or damage arising from LexiCAD, from any design or other output, or from these terms. This applies whatever the legal basis of the claim: contract, tort (including negligence), statute or any other. It includes loss or damage, including financial loss, injury or death, arising from:

  • errors, omissions or unsafe features in a design or other output;
  • anything made from a design by you or anyone else, including its making, use, sale or giving away, its failure, and any injury, death, fire or damage to property that results;
  • your reliance on a design, a measurement, a render or anything the AI says;
  • wasted material, machine time or failed prints or cuts;
  • interruption or unavailability of LexiCAD, loss of data or files, and files that have been cleared or can no longer be regenerated;
  • loss of profit, revenue, business or goodwill, and any indirect, special, incidental, consequential or punitive loss.

11.2 Cap. If we are liable to you for any reason despite section 11.1, including because a court decides that section 11.1 or any part of it does not apply or cannot be enforced, then to the fullest extent the law allows the total liability of us, our people and our service providers together, for all claims of every kind, is limited to the amount you paid us in the 12 months before the event that gave rise to the claim, and never more than CAD $100.

11.3 What these limits do not affect. Nothing in these terms excludes or limits liability for:

  • fraud, wilful misconduct or gross negligence;
  • anything else that the law does not allow a contract to exclude or limit.

Providing designs that are generated by AI and are not reviewed or tested, as section 5 describes, is the service these terms are about. It is not in itself gross negligence or wilful misconduct.

11.4 Why these limits exist. We offer LexiCAD, and set its prices, on the basis of the limits in sections 10 to 12.

11.5 Who these sections protect. Sections 5, 10, 11 and 12 protect our people and our service providers as well as the company. Each of them may rely on those sections as if they were a party to these terms, and we accept these terms for them as well as for ourselves. You agree not to bring against any of them a claim that these terms would not allow you to bring against us.

12. Your responsibility to us

12.1 You will defend us and our people against, and reimburse us and our people for, any claim, loss, damages, cost or expense (including reasonable legal fees and reasonable settlements) that we incur because of:

(a) an object made from one of your designs, where you made it, sold it or gave it away, or where it was made by someone you gave, sold or shared the object or its files with. This includes a claim by a person who is injured, including death, or whose property is damaged;

(b) your content, including a claim that it infringes someone’s rights, and a design you asked LexiCAD to base on someone else’s product, work or brand;

(c) what you share and who you share it with;

(d) your breach of these terms or of the law.

Each of (a) to (d) stands separately.

12.2 Claims that blame the design. Section 12.1(a) applies even if the claim says the design was defective or that we were negligent. You accepted the design unverified, and you chose to make the object or pass it on (section 5).

12.3 Limits. Section 12 does not make you responsible for a loss to the extent it was caused by our fraud, wilful misconduct or gross negligence. If a court does not enforce section 12.2 in full, you remain responsible for the share of the loss caused by your own acts, such as not checking the design, how you made the object, or selling it.

12.4 Handling a claim. We will tell you about a claim when we reasonably can. A delay does not release you, except to the extent it harmed your ability to respond. If we ask, you will take over the defence of the claim at your own cost, with lawyers we approve. Otherwise we may defend or settle the claim ourselves, with lawyers we choose, at your cost, and you will cooperate. We will not admit fault on your behalf without your agreement.

13. Deleting, suspending and closing

13.1 Deleting a design. You can delete a design at any time. Deletion is immediate and permanent and cannot be undone. To remove an uploaded file completely, delete the whole design: deleting a single uploaded file frees its storage but leaves it in the design’s stored conversation. Section 7.4 applies to designs created while training was on.

13.2 Deleting your account. You can delete your account in Settings. This permanently deletes every design in it, and any unused credits are lost. Section 7.4 applies to its designs. We keep the records described in the Privacy Policy, including invoices and payment records.

13.3 A copy of your information. You can ask for a copy of your content and of the personal information we hold about you, as the Privacy Policy describes. The copy does not include LexiCAD’s own internal working files for a design.

13.4 Suspension. We may suspend your account if you break these terms, if a payment is disputed (section 8.10), if we reasonably believe the account is being used for fraud or to cause harm, or if the law requires it. A suspended account shows a notice with our support address; write to us to ask why or to contest it. While an account is suspended you can still view your designs and download the files you could download before (except a design blocked under section 4.3), but cannot start new work.

13.5 Closure. We may close an account that breaks these terms, or that we are required by law to close. Its unused credits are then lost and are not refunded, except where the law requires.

13.6 What survives. Sections 1, 2.1, 2.3, 2.4, 3.7, 4 to 14, 15.5, 16, 17 and 18 continue to apply after your account is deleted or closed, however that happens.

14. Third-party services

LexiCAD relies on services provided by others, including AI model providers, a cloud host and a payment processor. Signing in with Google is governed by Google’s own terms. We are not responsible for services that we do not use to provide LexiCAD and do not control, such as your email provider, your bank or your fabrication machine’s software.

15. Changes to these terms

15.1 We may change any part of these terms. That includes what the service is and its limits, the rules of use, prices and how credits are used, how content is handled, and the legal terms. A change is either material, which needs notice (section 15.2), or not material, which does not (section 15.3). We make material changes no more than four times a year, unless the law or security requires one sooner. Prices are changed under section 8.7, without notice under this section.

15.2 Changes with notice. A material change is one that significantly affects what you pay, what you may do, or your legal position. For a material change we email every account at least 30 days, and not more than 90 days, before it takes effect. The email says that the terms are changing, gives the date the change takes effect, links to a page showing each changed provision as it will read, and says that continuing to use LexiCAD after that date means you accept.

15.3 Changes without notice. Any other change takes effect when the new terms are posted, with no email. Examples are corrections, clearer wording, updated contact details, and terms for a new feature. The effective date at the top of these terms always shows the version in force.

15.4 Your choice. If you do not agree to a change, stop using LexiCAD and delete your account before the change takes effect. You have the whole notice period to use your credits under the current terms; credits still unused when you delete your account are lost (section 8.8). If you continue to use LexiCAD after the effective date, you accept the change.

15.5 What a change cannot do. A change does not apply to events before its effective date. It never reduces the number of purchased credits you hold, and it never extends training to a design that already exists.

16. Governing law and disputes

16.1 Talk to us first. If you have a complaint, email support@lexicad.com. Before starting a legal claim, each of us will give the other 30 days’ notice of it by email (to support@lexicad.com, or to your account’s address) and try in good faith to resolve it. This does not stop you from bringing a claim sooner if waiting would cause you to lose a legal right, and it does not apply to our bringing you into another case under section 16.3.

16.2 Law. These terms, and any dispute about them or about LexiCAD, are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, whatever country you are in.

16.3 Courts. The courts of Ontario, Canada have exclusive jurisdiction over any claim about these terms or about LexiCAD. You agree to bring any claim only in those courts, and not to object to those courts hearing a claim. Two things remain open to us alone. If someone else brings a claim against us in another court about something section 12 covers, we may bring you into that case in that court. And we may ask a court anywhere to enforce a judgment or order of the Ontario courts.

16.4 Individual claims. To the extent the law allows, you and we agree to bring claims only on our own behalf and not as a plaintiff or member in a class or representative proceeding. Where the law permits, you and we waive trial by jury.

16.5 Business users. If you use LexiCAD for a business or other organization, you must start any claim against us within one year of the event it is about.

17. General

17.1 Whole agreement. These terms are the whole agreement between you and us about LexiCAD. The pricing and checkout pages state the price and what you are buying, and are part of each purchase.

17.2 If part is unenforceable. If any part of these terms is found invalid or unenforceable, in general or for a particular person or place, that part is limited or removed to the smallest extent needed and the rest continues to apply. Every section, and every sentence within a section, is separate from the others for this purpose.

17.3 No waiver. If we do not enforce a term, we may still enforce it later.

17.4 Transfer. You may not transfer your account or these terms to anyone else. We may transfer these terms as part of a sale, merger or reorganization of our business; your rights under them continue.

17.5 Events outside our control. We are not responsible for a failure or delay caused by something beyond our reasonable control, including failures of our providers, the internet or power.

17.6 Export and sanctions. You confirm that you are not located in, or ordinarily resident in, a country or region subject to comprehensive sanctions by Canada or the United States, and are not on a Canadian or United States government list of sanctioned or denied persons. You will not use LexiCAD to create, upload or share designs or technical data for anything section 4.1 forbids, or for any item controlled as a military item or on an export-control list, and you will not export or share a design in breach of export or sanctions law. You are responsible for export compliance for what you make and share.

17.7 Language. We do business in English. You agree that these terms, and all notices and other communications between you and us, are in English.
